TERMS OF SERVICE & PRIVACY STATEMENT

1. INTRODUCTION AND LEGAL AGREEMENT
These Terms of Service (“Terms”) govern your access to and use of www.ogpro.org (the “Site”) and all related educational content, memberships, courses, events, publications, digital products, and services (collectively, the “Services”) operated by OGPro Collaborative, LLC, a Wyoming limited liability company (“OGPro,” “Company,” “we,” “us,” or “our”).
By accessing or using the Services in any manner, you affirmatively acknowledge and agree that you have read, understood, and accepted these Terms, including the Medical & Practitioner Disclaimers, Limitation of Liability, and Arbitration Agreement, which materially affect your legal rights.
If you do not agree, you must immediately discontinue use of the Services.
2. ELIGIBILITY AND SCOPE OF USE
You must be at least eighteen (18) years of age to access or use the Services.
The Services are provided solely for educational and informational purposes and are intended for:
* Licensed healthcare professionals
* Veterinary professionals
* Dental professionals
* Students and researchers
* Non-clinical educational users
OGPro does not verify licensure, scope of practice, or regulatory compliance. You are solely responsible for ensuring your use of the Services complies with all applicable federal, state, provincial, and local laws, including Wyoming and Colorado professional practice statutes.
3. ABSOLUTE MEDICAL, VETERINARY, AND PRACTITIONER DISCLAIMER
(NO PRACTICE OF MEDICINE / NO RELIANCE)
3.1 No Medical Advice or Clinical Care
OGPro does not provide:
* Medical advice
* Veterinary advice
* Dental advice
* Diagnosis
* Treatment recommendations
* Prescriptions
* Clinical supervision
Nothing within the Services constitutes or should be construed as medical, veterinary, dental, diagnostic, or therapeutic advice, nor as a substitute for professional judgment.
3.2 No Practitioner–Patient Relationship
Use of the Services does not create:
* A physician-patient relationship
* A veterinarian-client-patient relationship
* A dentist-patient relationship
* Any fiduciary, advisory, or duty-of-care relationship
All clinical decisions are made independently and exclusively by the licensed professional.
3.3 No Establishment of Standard of Care
OGPro expressly disclaims any representation that its content:
* Reflects an accepted medical standard of care
* Represents consensus medical opinion
* Is endorsed by any regulatory body
* Should be adopted into clinical practice
Content may include experimental, emerging, historical, investigational, or non-standard concepts presented solely for educational discussion.
3.4 Professional Responsibility and Assumption of Risk
By using the Services, you acknowledge and agree that:
* You bear sole responsibility for how information is interpreted or applied
* Any clinical application occurs at your own professional risk
* You must obtain informed consent, where applicable
* You must comply with all scope-of-practice and licensing laws
* OGPro is not responsible for patient outcomes, adverse events, regulatory actions, or malpractice claims
4. EDUCATIONAL CONTENT DISCLAIMER (FDA & REGULATORY)
Statements made within the Services have not been evaluated by the U.S. Food and Drug Administration (FDA) or any state regulatory agency.
No content is intended to diagnose, treat, cure, mitigate, or prevent any disease or condition.
5. USER ACCOUNTS AND RESPONSIBILITIES
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
You may not:
* Misrepresent credentials or licensure
* Imply OGPro endorsement of your practice
* Use OGPro materials in a misleading or promotional medical context without written authorization
6. INTELLECTUAL PROPERTY AND LICENSE
All content is owned by OGPro or its licensors and is protected by U.S. and international intellectual property laws.
OGPro grants you a limited, revocable, non-exclusive, non-transferable license to access content for personal or professional educational use only.
Commercial reproduction, redistribution, or derivative use is strictly prohibited without written consent.
7. PROHIBITED USES
You agree not to:
* Provide medical advice while representing OGPro
* Use the Services to treat or diagnose individuals
* Represent OGPro materials as regulatory-approved protocols
* Use content to market unapproved medical claims
* Circumvent safeguards, licensing restrictions, or disclaimers
8. PAYMENTS, SUBSCRIPTIONS, AND NO REFUNDS
Fees for paid Services are disclosed at purchase.
All payments are final and non-refundable, unless explicitly stated otherwise in writing.
Subscriptions may auto-renew unless canceled prior to renewal.
9. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
OGPRO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. LIMITATION OF LIABILITY
(CRITICAL PROTECTION)
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
OGPRO SHALL NOT BE LIABLE FOR:
* PERSONAL INJURY OR DEATH
* MEDICAL OR VETERINARY OUTCOMES
* MALPRACTICE CLAIMS
* REGULATORY ACTIONS
* LOST PROFITS OR REPUTATIONAL HARM
* CONSEQUENTIAL OR PUNITIVE DAMAGES
TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
1. FEES PAID TO OGPRO IN THE PRIOR THREE (3) MONTHS, OR
2. $500 USD
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless OGPro from all claims arising out of:
* Your professional conduct
* Clinical application of educational materials
* Violations of licensure or regulatory requirements
* Third-party claims related to your use of the Services
12. ARBITRATION AGREEMENT AND CLASS ACTION WAIVER
All disputes shall be resolved by binding individual arbitration under the Federal Arbitration Act, administered by AAA or JAMS.
You waive any right to:
* Jury trial
* Class actions
* Representative claims
Arbitration shall occur in Wyoming, unless otherwise required by law.
13. GOVERNING LAW AND VENUE
These Terms are governed exclusively by the laws of the State of Wyoming, without regard to conflict-of-law principles.

OGPro may update these Terms at any time. Continued use constitutes acceptance.
